Expert Neutral Evaluation: Assessing The Impact of Workplace Conflict.

Introduction

At TCM, we offer a expert neutral evaluation in workplace disputes. In some cases, it may not yet be the right time or the situation may be too complex to offer workplace mediation or dispute resolution.

In more complex conflicts such as collective disputes; planned or current industrial action, team or group conflict or conflict involving complex factors such as multiple parties; multiple or counter grievances; or allegations of bullying, harassment or discrimination, you may wish to be provided with a neutral assessment of the situation before you proceed with an appropriate intervention.

One of our dispute resolution experts can undertake a speedy and objective evaluation of the current situation and provide a detailed report outlining the options available. We will ensure that we will work within the time limits laid within your own policies and the Dispute Resolution Regulations 2004. This report will offer a comprehensive evaluation of the potential role of mediation and/or an investigation etc. We will also attend debrief meetings as required. Please note that we will not disclose personal details or attribute what has been said directly to any party.
Mediation is much more interactive than litigation. It enables the parties to participate to a greater degree in exposing and resolving the issues at stake. They have a sense of ownership of the resolutions they agree which they do not have for court imposed solutions.

The process

During the evaluation, we will also be able to make all parties aware of the potential role of mediation, thereby allowing them to make an informed decision about their involvement in any future mediation or dispute resolution process.

Please note that this is not an investigation, moreover, we do not seek to attribute any blame or make a determination. We are simply assessing the suitability of the case for mediation and/or any other course of action.

We will collect a wide range of information about the parties, your organisation, the systems, cultures and other factors that may have contributed to the conflict.

The evaluation will result in a number of clear recommendations being made available through the final report.

Our ultimate aim is to get a broad overview of the conflict enabling us to make clear and objective recommendations that will allow for the future resolution of the conflict.

 

Independent Appeals Services

In the light of the Dispute Resolution Regulations (2004), one of the major failings of many organsiations disciplinary and grievance procedures is the absence of an effective and independent appeals mechanism.

TCM offers an Independent appeals service. We will hear an appeal and consider all of the evidence submitted in the course of a disciplinary or grievance process. By outsourcing your appeals process you can be assured of
  • Fairness
  • Impartiality
  • Rigour.
If the situation does then lead to a dismissal, it is more likely to be a fair dismissal. We can also make recommendations with regards to compromise agreements, mediation or other resolution procedures.

  • A meeting with key stakeholders (senior mangers, HR, trade unions etc)
  • Desktop evaluation of any relevant documentation and existing polices
  • Confidential questionnaires sent to appropriate parties
  • Semi structured telephone interviews with all parties
  • Confidential one to one interviews with all parties
